CSA CloudBytes: HIPAA Omnibus Rule (Thursday 6/13, 12pm Pacific)

On June 13th at 12:00pm (PDT), the CSA Health Information Working Group will be hosting a webinar on: The HIPAA Omnibus Rule The speakers will provide a detailed overview of the provisions of the HIPAA Omnibus Rule, which became effective March 26, 2013, with transition provisions extending through September 2014. Topics to be addressed will include the revised breach notification standard, patient access to information contained in an electronic health record, regulation of business associates and subcontractors, limitations on use/disclosure of PHI for marketing without authorization, prohibition on “sale” of PHI without authorization, research uses of data, patients’ right to restrict data sharing with payors, requirements to modify and redistribute notices of privacy practices, inclusion of limitations on use of genetic information for underwriting, clarification of the HHS Secretary’s role in enforcement, and imposition of civil money penalties (CMPs) and CMP liability for acts of agents. Gerry Hinkley is Chair of Pillsbury Winthrop Shaw Pittman’s Health Care Industry Team based in San Francisco. Gerry has practiced law in the health care industry for over 35 years. Gerry is recognized nationally as a leader in the fields of health privacy and information technology and offers clients extensive experience in medical confidentiality compliance and information technology procurement. Gerry is a frequent speaker and author on health care privacy and technology issues, a member of the Leadership Council of the eHealth Initiative and is Chair of the HIMSS Legal Task Force. Deven McGraw is the Director of the Health Privacy Project at CDT, where she focuses on developing and promoting workable privacy and security protections for electronic personal health information. Deven is active in efforts to advance the adoption of health information technology and electronic health information exchange to improve individual and population health. She was appointed by HHS Secretary Kathleen Sebelius to serve on the Health Information Technology Policy Committee and chairs its Privacy and Security Workgroup (the Tiger Team). She has testified on health privacy and security issues before Congress six times since 2008. Prior to joining CDT, Ms. McGraw was the Chief Operating Officer of the National Partnership for Women & Families, providing strategic direction and oversight for the organization’s core program areas, including promotion of initiatives to improve health care quality. Ms. McGraw also was an associate in the public policy group at Patton Boggs, LLP and in the health care group at Ropes & Gray. She also served as Deputy Legal Counsel to the Governor of Massachusetts.
